Terms & Conditions
1. Introduction
Cara Luxe Stays Pty Ltd (“Cara Luxe Stays”, “we”, “us” or “our”) provides short-term and temporary accommodation in New South Wales, Australia.
These Terms & Conditions apply to bookings made directly with Cara Luxe Stays, including bookings made through our website or direct booking platform.
By making a booking, completing our guest verification and check-in process, or staying at one of our properties, you agree to these Terms & Conditions and any house rules applicable to the property.
Where a booking is made through a third-party booking platform such as Airbnb, Booking.com or Vrbo/Stayz, the terms and conditions of that platform may also apply. Where there is an inconsistency relating to matters governed by the booking platform, the applicable platform terms will take precedence to the extent required.
2. Bookings and Payment
A booking is confirmed when Cara Luxe Stays or the applicable booking platform confirms the reservation and any required payment has been successfully processed.
The person making the booking must be at least 18 years of age and must have the legal capacity to enter into the booking.
The person making the booking is responsible for providing accurate booking and guest information and is responsible for the conduct of all guests included in the reservation.
Prices are displayed in Australian dollars (AUD) unless otherwise stated. Applicable taxes, cleaning fees, service fees or other charges will be shown as part of the booking process where applicable.
For direct bookings, payments are securely processed through our authorised payment provider. Cara Luxe Stays does not store guests’ full payment card details.
Any payment schedule, deposit or balance due will be displayed or communicated as part of the booking process.
For bookings made through third-party platforms, payment arrangements and platform fees may be governed by the applicable platform’s terms.
3. Rates, Fees and GST
All accommodation rates, cleaning fees and other charges applicable to your booking will be displayed or communicated before the booking is confirmed.
Unless otherwise stated, prices for direct bookings are quoted in Australian dollars (AUD) and include Goods and Services Tax (GST) where GST is applicable.
Rates may vary according to dates, length of stay, availability, demand, number of guests, property and booking conditions.
Additional charges may apply where permitted under these Terms & Conditions, including for additional cleaning, damage, missing items, unauthorised guests, late check-out or other costs reasonably incurred as a result of the stay.
For bookings made through a third-party booking platform, the total amount payable may also include fees or charges imposed by that platform.
Once a booking has been confirmed, the agreed accommodation rate will not be changed except where the booking itself is subsequently modified, additional services or charges are agreed or incurred, or an obvious pricing or administrative error requires correction in accordance with applicable law.
4. Cancellations, Changes and Refunds
Cancellation and amendment conditions depend on the rate, booking type and booking channel selected at the time of booking.
For direct bookings, the cancellation policy displayed during the booking process and included in the booking confirmation will apply to the reservation.
Any request to change the dates, number of guests or other details of a booking is subject to availability and approval by Cara Luxe Stays. A change may result in a change to the accommodation rate, fees or total booking price.
Where a guest is entitled to a refund under the applicable cancellation policy, the refund will be processed to the original payment method where practicable. Processing times may vary depending on the payment provider or financial institution.
Bookings made through third-party platforms such as Airbnb, Booking.com or Vrbo/Stayz are also subject to the cancellation, amendment and refund rules of the applicable platform.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
5. Guest Verification and Check-In Requirements
To help protect our guests, properties and accommodation services, Cara Luxe Stays may require the primary guest to complete a guest verification and check-in process before access to the property is provided.
The verification process may require the primary guest to provide their name, email address, phone number, a valid government-issued identification document such as a driver’s licence or passport, and a selfie or photograph for identity verification purposes.
The primary guest may also be required to confirm acceptance of these Terms & Conditions, applicable house rules and the Cara Luxe Stays Guest Agreement, and to provide an electronic signature.
Information provided as part of the verification process must be accurate, current and belong to the person making or responsible for the booking.
Cara Luxe Stays may withhold property access instructions until required guest verification and check-in requirements have been satisfactorily completed.
Where Cara Luxe Stays is reasonably unable to verify the identity of the primary guest, or where information provided appears false, fraudulent or materially inconsistent with the booking, we may contact the guest for further information and may refuse or cancel the booking where reasonably necessary and permitted by law.
Personal information collected during guest verification is handled in accordance with our Privacy Policy.
For bookings made through a third-party booking platform, any verification requirements imposed by that platform may also apply.
6. Check-In, Check-Out and Property Access
Check-in and check-out times applicable to the property will be stated in the booking confirmation and/or pre-arrival information provided to the guest.
Early check-in or late check-out is subject to availability and must be approved by Cara Luxe Stays in advance. Additional charges may apply where advised and agreed.
Property access details, including any access codes, keys or lockbox instructions, are provided for the use of registered guests only and must not be shared with unauthorised persons.
Guests are responsible for keeping keys, access devices and access information secure during their stay.
Guests must ensure that the property is securely locked whenever it is left unattended and when checking out.
Lost or unreturned keys or access devices may result in a reasonable replacement or security charge reflecting the cost incurred by Cara Luxe Stays.
Guests must vacate the property by the agreed check-out time unless a late check-out has been approved. Where an unauthorised late departure causes additional cleaning, staffing or other reasonable costs, the guest may be responsible for those costs.
Cara Luxe Stays may access the property during a stay where reasonably necessary for urgent maintenance, safety, security, emergency purposes or where otherwise permitted by law. Where practicable, reasonable notice will be provided to the guest.
7. Guests, Occupancy and Visitors
The number of overnight guests must not exceed the maximum occupancy permitted for the property or the number of guests included in the confirmed reservation, whichever is lower.
Only registered guests included in the reservation may stay overnight at the property unless prior approval has been obtained from Cara Luxe Stays.
Visitors may be permitted where reasonable, provided they comply with the property’s house rules and do not cause the maximum permitted occupancy to be exceeded. Guests remain responsible for the conduct of their visitors while at the property.
The primary guest making the booking is responsible for ensuring that all members of their group and any permitted visitors comply with these Terms & Conditions, the Guest Agreement and applicable house rules.
Parties, events, functions or gatherings are not permitted unless expressly approved in writing by Cara Luxe Stays in advance.
Guests and visitors must not cause excessive noise, nuisance, disturbance or unreasonable interference with neighbours or the surrounding community.
The property must not be used for any unlawful activity or for any purpose materially different from the accommodation purpose for which it was booked without prior approval.
Any occupancy limits, visitor restrictions or other requirements imposed by applicable laws, regulations, strata or building rules must also be observed.
8. House Rules and Guest Conduct
Guests must comply with the house rules applicable to the property, these Terms & Conditions, the Cara Luxe Stays Guest Agreement and any reasonable instructions provided by Cara Luxe Stays in relation to the safe and proper use of the property.
Guests and visitors must behave responsibly and must not cause excessive noise, nuisance, disturbance, harassment or unreasonable interference with neighbours, other occupants or the surrounding community.
Unless expressly permitted for the property, guests must not:

hold parties, events or unauthorised gatherings;

smoke or vape inside the property;
-
bring pets or animals onto the property without prior approval, except where required by applicable law;
-
engage in illegal, dangerous or disruptive activities;
-
tamper with smoke alarms, safety equipment, security devices or other property systems;
-
deliberately or negligently damage the property, furnishings, fixtures or equipment; or
-
use the property for commercial activities, functions, photography, filming or other purposes beyond ordinary accommodation without prior approval.
Guests must comply with applicable laws and regulations relating to short-term rental accommodation in New South Wales, including applicable guest obligations under the NSW short-term rental accommodation regulatory framework.
Serious or repeated breaches of these Terms & Conditions, the Guest Agreement or applicable house rules may result in reasonable action by Cara Luxe Stays, which may include requiring the conduct to cease, recovery of reasonably incurred costs, or termination of the stay where permitted by law.
Any termination, charge or other action taken by Cara Luxe Stays will be subject to applicable law and, for bookings made through a third-party platform, any applicable platform requirements.
9. Damage, Breakages, Additional Cleaning and Charges
Guests are responsible for taking reasonable care of the property, furnishings, fixtures, appliances and other items provided during their stay.
Guests must notify Cara Luxe Stays as soon as reasonably practicable of any damage, breakage, loss or maintenance issue that occurs or is discovered during the stay.
Where damage, loss or breakage is caused by a guest or visitor, beyond reasonable wear and tear, the primary guest may be responsible for the reasonable cost of repair, replacement or remediation.
Additional charges may also apply where Cara Luxe Stays reasonably incurs costs as a result of the stay, including for:

excessive or additional cleaning beyond a standard turnover clean;

damage to the property, furniture, furnishings, appliances or equipment;
-
missing or damaged items;
-
lost or unreturned keys or access devices;
-
unauthorised smoking or vaping;
-
unauthorised pets, where additional cleaning or remediation is required;
-
excessive rubbish or items requiring special removal; or
-
other reasonable costs arising from a material breach of these Terms & Conditions, the Guest Agreement or applicable house rules.
Any amount charged will be based on the reasonable cost incurred or reasonably expected to be incurred by Cara Luxe Stays. Where practicable, supporting information such as photographs, invoices, receipts or quotations may be retained.
For bookings made through a third-party booking platform, claims for damage or additional costs may be submitted and processed through that platform in accordance with its applicable procedures.
Nothing in this section makes a guest responsible for fair wear and tear, pre-existing damage, or costs that were not caused by the guest or their visitors.
10. Cleaning, Property Condition and Departure
A standard cleaning fee may form part of the booking price and covers the normal cleaning and preparation of the property between guest stays.
The standard cleaning fee does not cover excessive cleaning, damage, unusual waste removal or remediation required as a result of a guest's or visitor's actions.
Guests are not expected to professionally clean the property before departure. However, guests are expected to leave the property in a reasonably tidy condition and to follow any reasonable check-out instructions provided by Cara Luxe Stays.
Before departure, guests should:

place rubbish in the designated bins or areas as instructed;
-
remove personal belongings and food they do not wish to leave behind;
-
return furniture, furnishings and household items to their appropriate locations where reasonably practicable;
-
ensure keys or access devices are returned as instructed; and
-
leave the property reasonably tidy and secure.
Guests are not required to perform tasks that would ordinarily form part of the standard professional turnover clean.
Where the property is left in a condition requiring cleaning or remediation substantially beyond a normal turnover clean, Cara Luxe Stays may recover the reasonable additional costs incurred, subject to applicable law and any relevant booking-platform requirements.
Guests should report any damage, breakage, maintenance issue or significant spill as soon as reasonably practicable so that Cara Luxe Stays can take appropriate action and minimise further damage.
11. Safety, Security and Emergencies
Guests are responsible for taking reasonable care for their own safety and the safety of other guests and visitors while at the property.
Guests must comply with reasonable safety instructions provided by Cara Luxe Stays and must not tamper with, disable, remove or interfere with smoke alarms, fire-safety equipment, security devices or other safety systems at the property.
Children and any persons requiring supervision must be appropriately supervised by a responsible adult at all times.
Guests must use appliances, furniture, fixtures, outdoor areas and other property facilities safely and for their intended purpose.
Any hazard, damage, malfunction or maintenance issue that may affect health or safety should be reported to Cara Luxe Stays as soon as reasonably practicable.
In the event of a serious or life-threatening emergency, guests should contact the appropriate emergency service by calling 000 before contacting Cara Luxe Stays where immediate assistance is required.
Guests must not provide property access codes, keys or other security information to unauthorised persons and should ensure that doors and other relevant access points are secured when leaving the property.
Cara Luxe Stays may take reasonable action where necessary to protect the safety or security of guests, neighbours, the property or other persons, including arranging urgent maintenance or accessing the property where reasonably necessary and permitted by law.
Nothing in these Terms & Conditions excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under applicable Australian law.
12. Maintenance, Utilities and Service Interruptions
Cara Luxe Stays takes reasonable steps to ensure that the property, appliances, utilities and facilities are maintained in working order.
From time to time, maintenance issues, equipment failures or interruptions to services may occur, including interruptions to electricity, water, internet, television, air-conditioning, heating, appliances or other utilities and services.
Guests should notify Cara Luxe Stays as soon as reasonably practicable if they become aware of a maintenance issue or service interruption so that we have an opportunity to investigate and, where appropriate, arrange repair or assistance.
Cara Luxe Stays will take reasonable steps to address issues within its control as promptly as reasonably practicable, taking into account the nature of the issue, availability of tradespeople, parts and services, and the time at which the issue is reported.
Cara Luxe Stays is not responsible for interruptions or failures caused by utility providers, telecommunications providers, weather events, emergencies or other circumstances outside our reasonable control.
Where a significant issue materially affects the accommodation and cannot be reasonably resolved, any appropriate remedy will be considered having regard to the circumstances, applicable law and, where relevant, the terms of the booking platform through which the reservation was made.
Nothing in this section excludes, restricts or modifies any right or remedy available to a guest that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
13. Personal Property and Liability
Guests are responsible for taking reasonable care of their personal belongings during their stay.
Cara Luxe Stays is not responsible for loss, theft or damage to personal property except to the extent that the loss or damage is caused by Cara Luxe Stays or where liability cannot lawfully be excluded or limited.
Guests should ensure that doors and other access points are secured when leaving the property unattended and should not leave valuable items unsecured.
Any personal belongings left at the property after check-out should be reported to Cara Luxe Stays as soon as possible. Where an item is located, we will take reasonable steps to assist with its return. Guests may be responsible for reasonable postage, courier or other costs associated with returning lost property.
Cara Luxe Stays does not guarantee the security or availability of vehicles parked on public streets, shared areas or other locations not under our control.
To the extent permitted by law, Cara Luxe Stays is not liable for loss, damage, delay or inconvenience arising from circumstances outside our reasonable control.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
14. Smoking, Pets and Prohibited Activities
Smoking and vaping are not permitted inside the property.
Where smoking is permitted in an outdoor area, guests must dispose of smoking materials safely and must not cause smoke, odour, litter or nuisance to neighbouring properties.
Pets or other animals are not permitted unless the particular property allows them or prior approval has been obtained from Cara Luxe Stays. This restriction does not apply where an animal must be accommodated under applicable law.
Guests must not use the property for illegal activities or engage in conduct that creates an unreasonable risk to persons, property or the surrounding community.
The use or possession of illegal drugs or other prohibited substances, deliberate damage, violence, threatening behaviour and other unlawful activities are prohibited. Guests must not use the property for parties, events, commercial activities, filming, photography or functions beyond ordinary accommodation use without prior approval from Cara Luxe Stays.
Where additional cleaning, deodorising, remediation or repair is reasonably required because of a breach of this section, the primary guest may be responsible for the reasonable costs incurred.
15. NSW Short-Term Rental Accommodation Requirements
Guests must comply with applicable New South Wales laws, regulations and requirements relating to short-term rental accommodation, including applicable obligations under the NSW short-term rental accommodation regulatory framework and Code of Conduct.
Guests must not engage in conduct that unreasonably interferes with the peace, comfort or privacy of neighbours or other occupants of the surrounding area.
Guests must comply with reasonable directions relating to noise, parking, waste disposal, common areas, property security and the proper use of the accommodation.
Where applicable laws, regulations, strata or building rules impose additional requirements on a particular property, guests must comply with those requirements where they have been reasonably communicated to them.
Serious or repeated breaches may result in action permitted under applicable law, including termination of the stay where appropriate.
16. Circumstances Beyond Our Reasonable Control
Cara Luxe Stays will not be responsible for a failure or delay in performing an obligation where that failure or delay results from circumstances beyond our reasonable control.
Such circumstances may include severe weather, natural disasters, fire, flood, utility or telecommunications outages, government actions or restrictions, emergencies, industrial action, transport disruption or other events that could not reasonably have been prevented or controlled by Cara Luxe Stays.
Where such circumstances materially affect a booking, Cara Luxe Stays will take reasonable steps to communicate with affected guests and, where appropriate, assist in identifying a reasonable solution.
Any cancellation, refund, credit or alternative accommodation arrangement arising from such circumstances will be determined having regard to the circumstances, applicable law and, where relevant, the rules of the booking platform through which the reservation was made.
Nothing in this section limits rights or remedies that cannot lawfully be excluded.
17. Privacy
Cara Luxe Stays collects and handles personal information in connection with enquiries, bookings, guest verification, payments and accommodation services.
Our handling of personal information is governed by the Cara Luxe Stays Privacy Policy, which forms part of these Terms & Conditions and is available on our website.
Guests should review the Privacy Policy for information about the personal information we collect, guest identity verification, third-party service providers, storage and security, access and correction requests, data retention and privacy complaints.
18. Changes to These Terms and Contact Details
Cara Luxe Stays may update these Terms & Conditions from time to time to reflect changes to our accommodation services, operating practices, technology, legal requirements or regulatory obligations.
The Terms & Conditions applicable to a booking will generally be those provided or made available in connection with that booking, subject to any changes required by law or subsequently agreed with the guest.
